1.2 We process personal data in accordance with the Hong Kong Personal Data (Privacy) Ordinance (Cap. 486) (the "PDPO"), including the six Data Protection Principles (DPP1 to DPP6) set out in that Ordinance, and the guidance issued by the Office of the Privacy Commissioner for Personal Data ("PCPD").
1.3 This Policy applies to our collection and processing of personal data when you use the Services through the yawe.ai website, applications, enterprise and e-commerce workspaces, and API/SDK features made available by us in writing. It also applies to related processing carried out with Authorized Channels, enterprise customers and partners in order to deliver the Services.
1.4 This Policy forms part of the yawe.ai User Services Agreement (the "Agreement"). Where this Policy and the Agreement are inconsistent in respect of the protection of personal data, the provision more favourable to the protection of your personal data prevails. Mandatory provisions of law prevail over this Policy.
1.5 This Policy also serves as the Personal Information Collection Statement provided to data subjects in respect of the collection of personal data. In accordance with DPP1(3), at or before the time we collect personal data we inform you, expressly or implicitly, of the purposes of collection, the classes of persons to whom the data may be transferred, and your right to request access to and correction of your personal data. The purposes of collection are set out in Section 3, the classes of transferees in Section 5, and your access and correction rights in Section 9.
1.6 Where you are an enterprise customer and provide us with personal data of your employees, customers, models, creators or other third parties, you are generally the data controller for that data and are responsible for establishing a lawful basis and completing notice and consent procedures. We process that data as a data processor acting on your lawful instructions and within the scope of the applicable data processing agreement.
2. Categories of Personal Data We Collect
2.1 Account and identity data: name or nickname, email address, mobile number, encrypted password, account identifier, country or region, language preference, and login and verification records.
2.2 Enterprise and verification data: company name, registration number, registered address, authorised representative's name and contact details, and certificates and supporting documents submitted for enterprise verification (KYB), identity verification, payment-instrument verification or rights-documentation verification.
2.3 Payment and billing data: selected plan and subscription status, order number, transaction amount and currency, invoice and billing information, tokenised identifiers returned by the payment provider, credit balance and consumption records, and refund and chargeback records. We do not store your full card number or card verification value (CVV); payment credentials are handled by licensed payment service providers.
2.4 Content and asset data (User Assets): text, prompts, scripts, images, videos, audio, likeness and voice samples, templates, asset files and their metadata that you upload or generate; generation request identifiers, task status, model and version, resource consumption and delivery logs.
2.5 Sensitive data: where you voluntarily enable digital-human, likeness-replication or voice-replication features, we may process biometric data such as your facial images or voiceprint/voice samples. The leakage of such data may cause significant harm, and we process it only with your explicit consent and only to the extent necessary to deliver the feature you have selected.
2.6 Usage and technical data: device model and operating system, browser type, IP address, coarse location inferred from IP, access times, page and feature usage records, error and performance logs, and cookies and similar technology identifiers.
2.7 Support, complaint and compliance records: records of your communications with us, identity and authorisation verification outcomes, content-safety and complaint-handling records, and account enforcement and appeal records.
3. Purposes of Collection and Use
3.1 We collect and use the personal data described above for the following purposes:
- performance of contract: creating and managing accounts, delivering generation and editing features, processing orders and credits, providing customer and technical support, and handling after-sales requests;
- identity and enterprise verification: completing identity, KYB, payment-instrument and rights-documentation verification to meet platform, payment, security or legal requirements;
- service security and anti-fraud: preventing and detecting fraud, abuse, account takeover, anomalous calls and security incidents;
- service improvement: troubleshooting, anonymised or statistical analysis, and improving product features and user experience;
- customer communication: responding to your enquiries, complaints, appeals and rights requests;
- direct marketing: sending you promotional information about the Services, only after obtaining your consent under Part VIA of the PDPO;
- legal and compliance: complying with tax, accounting, record-keeping, content-safety, data breach handling and other legal obligations, and responding to lawful requests from competent authorities.
3.2 Under Part VIA of the PDPO, if we intend to use your personal data for direct marketing we will: (a) before first use, inform you of the classes of data to be used, the classes of goods or services to be marketed, and that supplying the data for that purpose is voluntary; (b) obtain your consent (including your response indicating whether you object to the intended use); and (c) obtain your consent again before using the data for a different purpose after first use. You may at any time withdraw your consent or request that we cease using your personal data for direct marketing by contacting us as set out in Section 9, and we will not charge you a fee for doing so.
3.3 We do not use your personal data for purposes unrelated to those set out above, or for any new purpose. If we need to change the purpose, we will provide separate notice in accordance with the PDPO and, where necessary and applicable, obtain your consent again.
4. Cookies and Similar Technologies
4.1 We use strictly necessary cookies to maintain your login session, session security and load balancing; preference cookies to remember your language and interface settings; and, in jurisdictions where consent is required, analytics cookies to understand how features are used after obtaining your consent.
4.2 You can manage or delete cookies through your browser settings. Disabling strictly necessary cookies may prevent some features from working properly.
5. Sharing, Processors and Classes of Transferees
5.1 We do not sell your personal data, and we do not trade your personal data for money or other benefits.
5.2 To deliver the Services, we may disclose personal data, to the minimum extent necessary, to the following classes of processors or partners, and we require them by contract to observe confidentiality and security obligations no less protective than those in this Policy. These categories are the classes of transferees notified to you under DPP1(3):

- customer support and ticketing system providers;
- professional advisers (lawyers, auditors, accountants);
- our company secretary, registered agent and other professionals to whom we are required by law to provide data;
- Authorized Channels authorised by us in writing, only to the extent necessary to deliver the services you purchased or activated through that channel.
5.3 We may disclose personal data to a successor entity or group company in connection with a merger, reorganisation, financing, transfer of business or intra-group reorganisation. The successor remains bound by this Policy and must not reduce the level of protection afforded to personal data.
5.4 We may disclose personal data where compelled by law, a court or a competent authority. To the extent permitted, we review the lawfulness of the request and limit disclosure to the minimum necessary.
6. Cross-Border Transfer
6.1 Our service regions, cloud providers, model providers and we ourselves may be located outside Hong Kong (including but not limited to mainland China, Singapore and the United States). Your personal data may therefore be transferred to, and processed in, places outside Hong Kong.
6.2 The restrictions on cross-border transfer in section 33 of the PDPO are not currently in force. Nevertheless, we implement safeguards in accordance with the PCPD's Guidance on Recommended Model Contractual Clauses for Cross-border Transfer of Personal Data and related recommendations, including appropriate contractual clauses, transfer risk assessment, obligations on recipients no less protective than the PDPO, and technical measures such as encryption and access control where practicable.
6.3 Where personal data flows across the boundary within the Guangdong-Hong Kong-Macao Greater Bay Area, we will, where applicable, adopt the Standard Contract for Cross-boundary Flow of Personal Information within the Guangdong-Hong Kong-Macao Greater Bay Area (Mainland, Hong Kong) issued by the Cyberspace Administration of China and the Innovation, Technology and Industry Bureau of the Hong Kong SAR, or another recognised arrangement.
6.4 You may request a summary of the cross-border transfer safeguards we currently apply by contacting us using the details in Section 15.
7. Retention Periods
7.1 We retain personal data only for as long as necessary to fulfil the purposes for which it was collected (or a directly related purpose), and in accordance with statutory minimum retention periods. Once a period expires, we delete or anonymise the data.
7.2 Indicative retention periods (subject to our internal data retention schedule):
| Data type | Indicative retention period |
|---|---|
| Account and identity data | For the life of the account, and 24 months after account deletion |
| Payment, invoice and tax records | In accordance with Hong Kong tax and accounting requirements 7 years |
| User Assets and generation records | Until three years after the last generation or publication of the relevant asset, to support content traceability, rights verification, complaints and dispute handling |
| Security and access logs | 12 months |
| Direct marketing consent and withdrawal records | 24 months after withdrawal, to evidence compliance |
7.3 We may retain specific data beyond the periods above where required by statutory retention obligations, for ongoing disputes or investigations, or as necessary to establish, exercise or defend legal claims.
8. Security Measures and Data Breach Handling
8.1 We implement technical and organisational measures proportionate to the risk, including encryption in transit and at rest, access control and least privilege, key and credential management, audit logging, vulnerability management, and employee confidentiality obligations and security awareness training.
8.2 Hong Kong law does not currently impose a mandatory notification obligation for personal data breaches. Nevertheless, we maintain internal procedures in accordance with the PCPD's Guidance on Data Breach Handling and Data Breach Notifications: where a data breach occurs that may cause significant harm to data subjects, we will, as soon as practicable, assess the incident, take remedial action, and notify the PCPD and affected individuals, including the cause of the breach, its likely consequences, and the measures taken or proposed.
8.3 Where you are an enterprise customer controlling end-user data, you are responsible for the corresponding incident response and notification obligations. We will provide reasonable assistance within the scope of the applicable data processing agreement.
9. Your Rights
9.1 Under the PDPO you have the following rights:
- right of access: to request whether we hold your personal data and to obtain a copy of that data (a data access request);
- right of correction: to request correction of personal data that is inaccurate, out of date, incomplete or misleading;
- objection to direct marketing: to require us at any time to cease using your personal data for direct marketing, or to withdraw consent previously given for that purpose;
- complaint: to complain to or seek assistance from the PCPD regarding our handling of your personal data.
9.2 How to exercise: complete the PCPD-specified data access request form (Form OPS003), or email Official@yawei.ai stating your account, the type of request and the identity information reasonably required. We may ask you to complete identity verification in order to protect data security.
9.3 We will comply with your data access request within 40 days after receiving it. If, in exceptional circumstances, we are unable to comply within 40 days, we will notify you in writing within that period of the reasons and of the period within which we can comply.
9.4 Under the PDPO we may refuse to comply with a data access request in certain circumstances (for example, where the request is not made on the specified form, where we do not hold the data, or where a statutory exemption applies). We will explain our reasons.
9.5 We may charge a fee that is not excessive for handling a data access request (for example, photocopying and postage costs), and we will tell you the fee in advance.
9.6 In addition to your statutory rights, on a reasonable request we may, where technically feasible, provide certain of your personal data to you in a structured, commonly used and machine-readable format. This is a voluntary arrangement on our part and is not a statutory right under the PDPO.
10. Minors
10.1 The Services are not directed at persons under 18 years of age. We do not knowingly collect personal data of minors.
10.2 If we become aware that we have collected a minor's personal data without appropriate consent, we will delete it as soon as practicable. If you believe we hold a minor's personal data, please contact us using the details in Section 15.
11. AI Features and Model Training
11.1 We may use automated means to conduct content-safety, anti-fraud, rights-verification and complaint handling on Inputs and Outputs. Except where necessary for content safety, compliance, troubleshooting or legally required handling, we do not routinely review content manually. Necessary human access is carried out under controlled, confidential and minimal conditions.
11.2 Unless you have separately opted in and consented (and that consent may be withdrawn at any time), we do not use your Inputs or Outputs to train general or shared foundation models made available to other customers. Content safety, anti-fraud, rights verification, complaint handling, service troubleshooting, and processing and retention carried out by processors as required by law, do not constitute model training.
11.3 You should avoid including in uploaded materials any personal data unrelated to the feature you have selected, in particular identity documents, health, financial, children's or third-party sensitive data. You represent that you have obtained valid authorisation covering AI processing, editing, reproduction, generation, storage, export and intended publication for any materials containing another person's likeness, voice, name or personal data, and you are responsible for claims arising from them.
12. Enterprise Customers and End-User Data
12.1 Enterprise customers generally act as data controllers in respect of end-user, employee or third-party personal data processed through the Services, and are responsible for the lawful basis, notice and consent, responding to rights requests, retention periods, cross-border arrangements and security measures.
12.2 We process that data as a processor in accordance with the applicable data processing agreement, the enterprise customer's lawful instructions and applicable law, and will promptly inform the enterprise customer where an instruction may breach applicable law.
12.3 Enterprise customers must ensure that processing by their administrators, members and invited users is internally authorised, and must promptly adjust or remove permissions when a member leaves, changes role or the engagement ends.
13. Users in Other Jurisdictions
13.1 We operate from Hong Kong and serve users globally. In addition to the PDPO, where the data protection or privacy laws of your jurisdiction apply to our processing of your personal data, we will comply with the mandatory requirements of those laws.
13.2 For example: if you are located in Malaysia, the Malaysian Personal Data Protection Act 2010 and its amendments may apply to the relevant processing; if you are located in the European Union or the United Kingdom, the EU General Data Protection Regulation (GDPR) or the UK GDPR may apply. To the extent those laws apply, we will provide you with rights and protections no less than those required locally, and the rights set out in this Policy do not exclude any rights you have under mandatory local law.
13.3 Where this Policy conflicts with the mandatory law of a jurisdiction, that mandatory law prevails in respect of users in that jurisdiction.
14. Changes to This Policy
14.1 We may update this Policy due to legal, regulatory, technical, functional or business changes, and will publish the version number and effective date within the Services.
14.2 For changes that have a material adverse effect on the purposes of collection, categories of personal data, transferees, cross-border transfers or your rights, we will provide prominent advance notice through in-app notifications, your account email or a website announcement. Where applicable law requires fresh consent, we will implement the relevant processing only after obtaining your consent.
14.3 You can identify previous versions of this Policy from the version information stated in it.
